Adsin
Media reserves the right to suspend or cancel a customer's
access to any or all services provided by Adsin Media
when Adsin Media decides that the account has been inappropriately
used or otherwise. Adsin Media reserves the right to
refuse service and /or access to its servers to anyone.

Accounts are to be used
by the primary owner only. Account holders are not permitted
to resell, store or give away web-hosting services of their
website to other parties without formal consent from Adsin
Media. Web hosting services are defined as allowing a separate,
third party to host content on the owner's web site. Exceptions
to this include ad banners, classified ads, and personal ads.
Customers violate our policy and the Services Agreement when
they, their affiliates or subsidiaries engage in the following
activities: |

Pornography and pornographic
related merchandising are prohibited under all Adsin Media's
Windows 2003 hosting services. This includes sites that include
links to pornographic content elsewhere. Further examples
of unacceptable content or links include pirated software,
"hacker" programs, archives of "Warez Sites", game rooms or
MUDs, IRC Bots, Egg Drop programs, any kind of illegal software
or shareware. In addition sites offering online gambling,
casino functionality, sports book betting (including offshore),
and Internet lotteries are prohibited. |

Engaging in activity that
infringes or misappropriates the Intellectual Property rights
of third parties, including copyrights, trademarks, service
marks, trade secrets, software piracy and patents and other
similar rights held by third parties shall result in termination
of all "subscribers" privileges on the "Adsin Media" system.

Adsin Media promotes a mutually professional relationship
with its customers. Obscene, abusive, threatening or otherwise
harassing communications with agents of the Company, via
telephone, email, online chat or other means will result
in immediate account termination not withstanding any other
terms of this agreement. Violation of this will result in
refund ineligibility.

Defamatory speech distributed
over the Internet can result in civil liability for the defamer
and litigation against the Web Hosting Provider (Adsin Media)
whose facilities were used to distribute the defamatory material.

Violation of indecency and obscenity laws can result
in criminal penalties. |
|
| |
|
|
| |
|
|
| |
Distribution of Internet
viruses, worms, Trojan horses and other destructive activities,
such as hacking, can result in serious civil and or criminal
liability under federal and state law. |

| |
|
|
| |
The illegal or unauthorized
accessing (often known as "hacking") of computers or
networks carries potential civil and criminal penalties
under both federal laws and the laws of most states/countries.

|
| |
Adsin Media's windows platform hosting services are not
to be used as a software/image repository. This means you
cannot use your account to store images that are pulled
from another website. An example of this would be storing
images to be pulled from an eBay auction site. HOWEVER,
this is permitted on Linux and UNIX hosting plans and where
formal consent is given by Adsin Media, on the windows hosting
plans.

Customer acknowledges
that Adsin Media cannot provide technical support for any
software and/or script that the Customer installs, other than
variable name changes. Customer also acknowledges that Adsin
Media does not supply technical support for Microsoft FrontPage,
other than initial configuration. Adsin Media supplies technical
support for web hosting issues only. Adsin Media shall be
the sole arbiter as to what constitutes a "webhosting" issue.

Our servers may not be
the source, intermediary, or destination address involved
in the transmission of spam, flames, or mail bombs. Your domain
may not be referenced as originator, intermediary, or reply-to
address in any of the above. SPAM /illegal content advertising
sites on other servers which in turn contain links to a domain
on our servers is prohibited. We consider spam any mass unsolicited
message in the mediums of Newsgroups and Email. If you are
found to have spammed, then we will immediately, without warning,
disable your domain. In addition, we will impose a $100 penalty
for each spam policy violation. Penalty for subsequent violations
will be higher. We reserve the right to refuse or cancel service
to known spammers. Lastly, we reserve the right to determine
what violates this policy. As such, any violation will result
in immediate deactivation of services without refund. Server
Abuse: Any attempts to undermine or cause harm to a server
is strictly prohibited. |

Resources are defined
as bandwidth and/or processor utilization. Adsin Media may
implement the following policy to its sole discretion: When
a website found to be monopolising the resources available,
the site will be immediately suspended. The account holder
will then be contacted in order to discuss the situation.
If no arrangement can be reached, Adsin Media reserves the
right to terminate the customers account without refund. |

All accounts are set up
on a prepay basis. Although Adsin Media reserves the right
to change prices of accounts or services at any time, all
pricing is guaranteed for the period of prepayment. Payment
is due each anniversary year or month following the date the
account was established. Customers will automatically be charged
again at the end of their prepay period unless closure notification
has already been given. In situations where payment has not
been received Adsin Media will immediately suspend the hosting.
In addition, Adsin Media reserves the right to suspend other
services until the outstanding debt is cleared. The customer
is responsible for all money owed on the account from the
time it was established to the time that the customer sends
a written cancellation request. No bills or invoices will
be sent by regular mail. All invoices will be sent directly
to customers via email. |

Credit Card / Cash / Cheque
Payment
Adsin Media cannot guarantee that a service will be provided
until payment has been received and cleared. We will suspend
all accounts where payment is not received. All accounts that
require domain registration must be paid prior to account
setup. |

Adsin Media reserves the
right to cancel the service at any time. In this event customers
will be entitled to a pro rata refund based upon the remaining
period of membership. If a customer contravenes Adsin Media's
terms of service a refund will not be issued in the event
of a cancellation. Customers may cancel their account at any
time, by giving 1 months notice in writing. Refunds will be
given at the discretion of the Adsin Media Management. Fees
charged on a prepay basis are non-refundable. |

Customer agrees that it shall defend, indemnify, save and
hold Adsin media harmless from any and all demands, liabilities,
losses, costs and claims, including reasonable attorney's
fees asserted against Adsin Media, its agents, its customers,
officers and employees, that may arise or result from any
service provided or performed or agreed to be performed
or any product sold by customer, its agents, employees or
assigns. Customer agrees to defend, indemnify and hold harmless
Adsin Media against liabilities arising out of; (1) any
injury to person or property caused by any products sold
or otherwise distributed in connection with Adsin media's
server; (2) any material supplied by customer infringing
or allegedly infringing on the proprietary rights of a third
party; (3) copyright infringement and (4) any defective
products sold to customer from Adsin Media's server.

Adsin Media will not be responsible for any damages your
business may suffer. Adsin Media makes no warranties of any
kind, expressed or implied for services we provide. Adsin Media
disclaims any warranty or merchantability or fitness for a particular
purpose. The includes loss of data resulting from delays, non-deliveries,
download speeds, availability, wrong delivery, and any and all
service interruptions caused by Adsin Media and its employees.
Adsin Media reserves the right to revise its policies at any
time. |
